Judge Strikes Down Ephedra Ban

A federal judge Thursday struck down the FDA ban on ephedra (search), the once-popular weight-loss aid that was yanked from the market after it was linked to dozens of deaths.

The judge ruled in favor of a Utah company that challenged the Food and Drug Administration's ban. Utah-based Nutraceutical (search) claimed in its lawsuit that ephedra "has been safely consumed" for hundreds of years.

Supplements that included ephedra have been widely used for weight loss and bodybuilding, but have linked to 155 deaths, including that of Baltimore Orioles pitching prospect Steve Bechler (search). The FDA ordered the substance off the market in April 2004.

Judge Tena Campbell's ruling sends the matter back to the FDA "for further rulemaking consistent with the court's opinion" and keeps the agency from enforcement action against the companies.

FDA officials did not immediately return a call seeking comment.

Company president Bruce Hough said the decision is about "protecting the public's access to safe and effective dietary supplements."

hmmm...I never understood how they could ban it in the first place...but I hope the ban is lifted

Very interesting, personally i feel the drug was rightfully banned, but this should cause quite the stir.

The only way I would feel that the ban was correct, is if they banned cigarettes, alcohol, fast food, etc.

ephedra has been "linked" () to 155 deaths....and I'd say 90% of those are a result of the drug being used improperly...Example: that fucking moron pitcher Steve Bechler

if the government actually cared about the citizens well being, they would of banned cigarettes a long time ago. But they can't since tobacco companies contribute a shitload of money.

Hey Tech, there are lots of reasons why ephedra should be banned. Bottom line is there have been hundreds of studies showing the dangers, you really wont find anyone credible source who understands the metabolic pathways of the drug that finds it risk free. It has a dangerous drug that has been linked to cardiovascular disease, hpertension, gastrointestinal problems, stroke, heart palpitations, heart attack, death. Do a quick search on scholar.google.com and a lot of good reads show up.

I see what your saying. And I don't wanna give off the wrong impression. I am against the banning of ephedra because I am a firm believer in personal choice. If you look at some of the prescription drugs on the market, there are many that are 10x more dangerous than ephedra.

Honestly, when people have asked me about ephedra based products, I always advise them against using it. Ephedra gained a bad reputation because it was abused by people who knew little about what it did.

Moral of the story: I don't like the government telling me what I can and can't do

A few weeks after the ban in the US took place, europe followed.

Though in countrys like russia i remember they didn't ban it, and so companys in usa/europe can still produce ephedra products for export purposes only, so ship to for example russia.

Yeah, well ephedra was and still is the best fat burner in my opinion. But Hdogg345 is right when he says that it is a drug that is not fully understood. I feel bad for the people that died. But then again they really did go hardcore with the shit. Ever notice how in middle school they teach you about not taking drugs and overdosing and all that shit, then when you hit highschool, (your prime age for abusing any substance) they don't teach you shit no more. Make sense?? And they still sell smokes and liquor?? Fucking money hungry greedy government. Anyways, I'm against the ban.

Ephedrine is still easy to get. Pure ephedrine HCL can be bought at your local truck stop.

The hypocritical FDA a-holes can ban all they things they want to, it's not going to stop anyone if they really want something.
